1. Introduction

PLEASE READ THESE TERMS OF SERVICE CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. THESE INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS.

The following conditions will regulate the commercial and legal relationship between

Hob Srl – the company owner of the website Ventureonboard.com (the “site”) (also referred to “us” or “we”)

And

The user of the website Ventureonboard.com, identified at the login of the site and who is willing to obtain services from the same site.
Through the site, Hob Srl provides an online platform that helps connect:

• Boat owners that are willing to rent out their boat as a general charter or as a bareboat charter with or without skipper
• Service providers such as, boat rentals, events, sports and recreational activities, ordinary and extraordinary maintenance, tourist guide, etc.

To

People that wish to find “accommodation” on a boat or to “rent” a boat or otherwise “use” of the published boats and / or of the published services both on the water and on land.

The use of this site is intended to provide online resources and tools to facilitate the meeting and the conclusion of contract between demand and offer directly between “Boat Owner” / “Vob Managers” “(Boat operator and/or Services Operator)” and “Users”, guaranteeing a high level of quality of the service.

YOU UNDERSTAND AND AGREE THAT VENTUREONBOARD.COM IS NOT A PARTY TO ANY AGREEMENTS ENTERED INTO BETWEEN VOB MANAGER AND USER/CLIENT, INCLUDING, BUT NOT LIMITED TO, MARINAS, MECHANICS, TECHNICIANS, YACHT MANAGEMENT SERVICES, CAPTAINS OR OTHER SERVICE PROVIDERS ON VETUREONBOARD.COM (COLLECTIVELY “AFFILIATES”), NOR IS VENTUREONBOARD.COM A TRANSPORTATION SERVICE, AGENT, BOAT BROKER, TOURIST AGENCY OR INSURER.

BOAT OWNER AND/OR VOB MANAGER, SHOULD PAY PARTICULAR ATTENTION ON HOW THE LAW WORKS IN THEIR RESPECTIVE STATES, CITIES, OR LOCATION WHERE THEY ARE OFFERING THEIR SERVICES.

Acceptance of Terms and Conditions and Privacy Policy

BY ACCESSING OUR SITE AND/OR USING OUR SITE AND SERVICES, WHETHER OR NOT YOU BECOME A REGISTERED USER (MEMBER), YOU AGREE TO COMPLY WITH AND BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS OF (“TERMS”) AND THE TERMS OF OUR PRIVACY POLICY (WHICH IS INCORPORATED INTO THESE TERMS BY REFERENCE AND WHICH YOU ACKNOWLEDGE TO HAVE READ AND UNDERSTOOD). IF YOU DO NOT AGREE TO THESE TERMS YOU MUST NOT AND HAVE NO RIGHT TO USE THIS SITE OR THE SERVICES.

You understand and agree that Hob Srl is not a party to an agreement undertaken between the publisher of the offer (Vob Manager) and who has booked such offer (customer). You understand that Ventureonboard.com is not a broker, an agent, an insurer, or other operation outside of this role. Ventureonboard.com has no liability for the behavior of the users of the site and does not assume any liability regarding it.

You understand and agree that there may be situations in which you may be required to sign, in addition to these terms, a further “All Service Agreement” by the Vob Manager of the Yacht you are booking through the website.
YOUR ATTENTION IS BROUGHT TO THE SECTIONS (Disclaimers, Limitation of Liability, Indemnification) WHICH INCLUDE OUR DISCLAIMERS, LIMITS OF LIABILTY AND YOUR INDEMNITY TO US UNDER THESE TERMS.

Modifications

We reserve the right, at our sole discretion, to change, modify or otherwise alter these Terms at any time without prior notice. You may review the latest version of these Terms at Ventureonboard.com If we modify these Terms we will post any changes on the site. By continuing to use this site or our Services after we have posted modifications to these Terms, you are indicating that you agree to be bound by the modified Terms.


2. Key Terms

Account: a User account for the site registered in accordance with section “Accounts”.

Accommodation: the boat in which the stay take place.

App: any application for provision of the Services on mobile devices developed and made available by Ventureonboard.com.

Yacht / Boat: any boat (motor boat, sailing boat, mega yacht, Yacht etc.) or other water-based vessel, (yacht, surf, paddle, canoe, houseboat etc.) which is offered as a listing on the site.

Confirming request time: is the time period starting from the time when a booking is requested by a guest (as determined by Ventureonboard in its sole discretion), within which a Vob Manager may confirm or reject that booking request, as stated on the site or App. Different Confirming Request Time may apply in different places.

Vob Manager: a User who has established an Account in order to create a listing and offer an available boat, any kind of activity or service, in the platform. When referring to the listing of a Boat, the Vob Manager can be the Boat Owner himself or must be appointed by the Boat Owner with the tasks and responsibilities of managing the offered listings, bookings, accommodation of the Customers, and any other services related to the listed offer.

Boat Owner: the owner of the Boat in a Listing.

Captain: the person with all physical, moral and legal requirements together with a significant marine experience to drive a boat. She/he can be the Vob Manager himself or must be appointed by the Vob Manager.

Content: text, graphics, images, music, software (excluding any App), audio, video, information or other materials.

Ventureonboard.com’s Content: all content, as above, not entered by the users, but provided by Ventureonboard.com, for services, subscriptions, other third-parties licensed content.

Common Content: all the contents of users and Ventureonboard.com.

Customer / Guest: a User who has established an Account, who requests from a Vob Manager a booking of a Listing via the site, Application or Services, or a Member who place an order through the site, App or Services and is not the Vob Manager for the associated Listing.

Listing: the listing of a boat that is available for Accommodation, Rental or other services, the listing of a maintenance and/or repair service, the listing of an event and/or an excursion (called also experience), published on the site, App or Services in accordance with Section “Listings”.

Management Fees: costs associated with general maintenance and use of the web site. Costs are non-refundable.

Member: one who complete an Account Registration with Ventureonboard.com, including but limited to Vob Managers and Guests.

Privacy Policy: the Ventureonboard.com Privacy Policy, which forms part of these Terms “Ventureonboard.com Privacy Policy”.

Security Deposit: a security deposit payable by a Customer in respect of a Rental or a Boat as more particularly described in section (Fees, Charges and Payment).

Site: the website www.ventureonboard.com and all related webpages. Any reference in these Terms to the ‘site’ is to be extended also to the related App operated by Ventureonboard.com.

Taxes: any sales taxes, value added taxes (VAT), goods and services taxes (GST), transient occupancy taxes, tourist or other visitor taxes, Boat or lodging taxes, fees that Boat or Service providers may be required by law to collect and remit to governmental agencies, and other similar municipal, state, federal and national indirect or other withholding and personal or corporate income taxes.

User: a visitor of the site.

Hob Srl, ‘We’, or ‘Us’: the company registered in the United Kingdom and all staff that works, directors, employees, agents, affiliates, and anyone acting in the name and on behalf of Ventureonboard.com.


3. Website Access restriction

The site and Services are intended solely for persons who are 18 years old or the age of majority by the State of nationality. Any access to or use of the site or Services by anyone under 18 is expressly prohibited. By accessing or using the site or Services, you represent and warrant that you are 18 or older.


4. Ventureonboard.com‘s Purpose and Role

You acknowledge and agree that the site is a platform, which allows registered Vob Managers and Customers to meet online and arrange for the booking of a Boat, a holiday, for an event or excursion, or for other services, directly between the two parties. Ventureonboard.com is not a party to any legal contract for the booking of the offer listed, which is entered into directly between Vob Manager and Customer and Ventureonboard.com disclaims all liability arising from or related to any such contract to the fullest extent permitted by law. Ventureonboard.com’s role is solely to facilitate the availability of the site and Services.
Ventureonboard.com:
(i) is not an owner, operator or charterer of any boats or other vessels or vehicles or other general property; (ii) is not a travel agent, broker or insurer; (iii) does not sell, resell, furnish, provide, rent, re-rent, charter manage and/or control any boat or general rental; (iv) does not provide any related transportation or travel services; (v) does not provide any kind of service management, maintenance or repair services and similar.

Other than, in its capacity as limited payment collection agent for accepting payments from Customers, Ventureonboard.com has no authority to act for, or enter into contracts or other binding obligations on behalf of either Vob Managers or Customers. We have no control over, and shall have no responsibility for, the acts or omissions of any Vob Managers or Customers.

Ventureonboard.com can not control the content (photo, description and so on) for all lists placed by Owners / Vob Manager, nor the conditions and compliance with existing rules of all listed offers, Ventureonboard.com declines any responsibility for these issues and any the user is the only responsible party for any reservation made through the platform.
It is the sole responsibility of Users (both Vob Managers and Customers) to assess a proposed booking (including the proposed Vob Managers or Customers, as applicable) and decide whether they wish to proceed. Ventureonboard.com does not make any recommendations and/or endorsements nor give any warranty or guarantee in respect of any offer listed on our site. Ventureonboard.com makes no warranty or guarantee as to the appropriateness or conduct of any Vob Manager, Captain, or Customer. We encourage Users to communicate directly with one another (using the messaging system available on the site) regarding any bookings or listings and to satisfy themselves that they have obtained and are satisfied with all the information they need before proceeding with a particular booking.


5. Prohibited Activities

The site provides a platform for Vob Managers or Customers to meet and arrange for the booking of the following services: Boat Accommodation, Boat Rental, Captained charter, boat holiday, ticketing for trips, events, or excursions, cleaning services, maintenance, repair services and other sport activities.
In any case, a customer or a guest infringes any of these terms and conditions or undergo any illegal activities in the country / countries visited during the use of the service, the Vob Manager has the right to end the service in advance without any refund.
Any contrary act to the laws and regulations of any country visited during the service will result in the full refund of the damage suffered by the boat, the crew and the Vob Manager.
Vob Managers or Customers are strictly prohibited from discussing and/or making arrangements via the site in respect of any services other than the purpose of the website or services, which are directly ancillary. Ventureonboard.com shall not permit any transaction to be conducted through the site where it has reasonable cause to believe that arrangements are being made in breach of this clause. Furthermore, Ventureonboard.com reserves the right to terminate or suspend any User’s Account where it has reasonable cause to believe that such User has acted in breach of this clause.
It is forbidden to propose and deviate in any case the user to other services offered by other sources other than the Ventureonboard.com site. If You conclude or accept a payment outside of our web platform you will be obliged to pay to Ventureonboard.com a minimum penalty of GBP 11,000.00 (eleven thousand GBP) for each violation found; we reserve the right to ask a compensation for additional damages.


6. Specific conditions for Accommodation

For the Vob Manager:
You warrant, represent and undertake that any listing you publish on Ventureonboard.com relate to an available Accommodation in an existing boat or vessel, it is in seaworthy conditions, safe and suitable to host people. All the licenses and permissions must respect the law of your nationality and the law of the Nation where the boat is registered.
As Boat owner or Vob manager you are entirely responsible for all the details provided about the boat; you must have a comprehensive knowledge of all the requirements, rules and regulations about boat property and utilization, upon the jurisdiction where the boat will be used.

IT IS YOUR OWN RESPONSIBILITY that the vessel complies with these minimum requirements (this is a qualitative list, not to be considered exhaustive):
1. Must have a valid authorization of the marina berths or moorings;
2. Must not breach any agreements you have entered into with any third parties;
3. Must be in compliance with all applicable laws (such as laws governing the rental of boating accommodation or accommodation generally in the jurisdiction in which the Accommodation is located), Tax requirements, and any rules and regulations that may apply to any Accommodation included in a Listing you post (including having all required permits, licenses and registrations);
4. Must guarantee the good condition of the vessel, following regulations and producer recommendations
5. Must meet all the security requirements;
6. Must maintain proof that the boat has his own valid insurance policy, included one for offered services, as required by applicable law;
7. Must meet minimum security, health and cleanness requirements
8. Must have full tank (water) at the check-in and guarantee all services feasibility;
9. Must guarantee that every modification or alteration was done under due authorization by the constructor or by the Certification Authorities recognized by its jurisdiction;
10. Please note that the compliance with whatever requirement is on the owner of the boat and in no case, this website can be considered responsible.

The Vob Manager or a delegate has also these duties:

1. Welcome the customers at the time and at the place agreed on the booking;
2. Check the identity of the customers;
3. The delegate has to declare his qualification during check-in procedures;
4. Teach the customers the basic instructions to the use of all facilities (rooms, kitchen, bath, living room, equipment, facilities);
5. Inform on specific rules to keep in the boat;
6. Be available for assistance and emergency situations;
7. Check the boat to analyze with the clients any previous damage;
8. Be present at the checkout. After the checkout, the Vob Manager has a 24-hrs period to denounce any damage, theft, or abuse inside or outside the vessel or boat during the use of the service by the customers.
IF YOU ARE NOT THE OWNER OF THE VESSEL IN USE FOR THE ACCOMODATION, YOU REPRESENT, WARRANT AND UNDERTAKE THAT YOU HAVE THE EXPRESS AUTHORIZATION FROM THE OWNER TO DEAL WITH THE VESSEL, INCLUDING CREATING LISTINGS RELATED TO IT AND OFFERING IT FOR RENTAL AS ACCOMODATION.
For the customer:
You warrant, represent and undertake that your behavior and your use of the services through Ventureonboard.com will comply with the following conduct code. In particular:
1. Must have a legal age;
2. Be responsible for under age passengers;
3. Must exhibit a valid identification document to the Vob Manager (or other person in charge), a valid document must be provided for every passenger;
4. Must leave the accommodation at the day and at the time of the check-out in the booking. The Customer is authorized to stay on the boat or on the vessel just for the period agreed on the booking. The customer will be charged for each additional 24h of staying with a fee doubled than the normal fee, in additional to all legal fees to make the customer leave the boat;
5. Must respect the properties and do not damage or steal any part or any object inside or outside the vessel or the boat;
6. May be held liable for the repair cost of all other repairs or damage to the boat arising during the accommodation, and must follow the reporting, claims processing, and repair procedure for all such damage;
7. Must not move or navigate of any vessel or boat away from its berth or mooring;
8. Must not host more people than what you booked;
9. Must follow the rules of good civil behavior (including noise, not to disturb or create any damage to any third parties);
10. Must not commit illegal activities inside the vessel or the boat;

Any kind of abuse of the following rules, including damage toward people, properties of any third party will be punishable by law. Hob Srl is not responsible for any misconduct of the customer.

In addition, to the correct use of the service, the customer has these duties:

1. Must meet the Vob Manager at the time and at the place agreed on the booking;
2. Must respect any other additional specific conditions given by the Vob Manager agreed on the welcome stage;
3. Must declare any specific and particular needs at the Vob Manager during the booking or during the welcome stage.


7. Specific conditions for Rental

Boats listed on www.Ventureonboard.com must be chartered under the rules that apply to Rental/ Charter, Bareboat Charter, Captained Charter, based on good navigation practices in the jurisdiction where the boat will be chartered or rented.

Following are a few definitions for clarity purposes:

“Bareboat Charter” is defined as a rental where the “boat owner” does not accompany the “renter” nor provide a paid captain to accompany the “renter” during the “rental period”.

“Captained Charter” is defined as a rental where the “boat owner” either acts as captain or provides a paid captain to accompany the renter during the “rental period” for the private pleasure use of the “renter” or watersports, charter fishing, sightseeing, or dinner cruises only. Such rentals shall be designated as “captained rental” on the “Rental Agreement.” All other commercial or business use, governmental functions or purposes, or any other non-private pleasure use is excluded.

Here are some basics of bareboat charters:

• The owner retains the title of the vessel for the duration of the bareboat charter;
• The renter stands in the shoes of the owner for purposes of managing the boat;
• The renter is responsible for the safe navigation of the vessel;
• A bareboat charter can only carry up to 12 passengers plus paid crew;
• A bareboat charter cannot carry passengers for hire;
• If a captain is retained the charterer must hire the captain;

However, the Vob Manager and the customer are solely responsible to know and follow all laws and regulations related to bareboat chartering, with or without captain, in the jurisdiction of the boat’s location.
For the Vob Manager:
You warrant, represent and undertake that any listing you publish on www.Ventureonboard.com relate to an available and existing boat or vessel, it is in seaworthy conditions, safe and suitable to host people, free of any known fault of defects that would affect its safe operation and navigation under normal use and that the vessel / boat conforms to the eligibility requirements as stated in the Boat Eligibility Requirements. The service of Rental is intended for PERSONAL USE ONLY.
As Owner/Vob Manager, YOU ARE ENTIRELY RESPONSIBLE for any detail provided on the website, for any rule and regulation on boat property and its utilization, in conformity with the suitability requirements upon the jurisdiction where the boat will be used.
IT IS YOUR OWN RESPONSIBILITY that the vessel / boat complies with these minimum requirements (this is a qualitative list, not to be considered exhaustive):
1. Must have a valid authorization of the marina berths or moorings;
2. Must not breach any agreements you have entered into with any third parties;
3. Must be in compliance with all applicable laws (such as laws governing the rental of boating accommodation or accommodation generally in the jurisdiction in which the Accommodation is located), Tax requirements, and any rules and regulations that may apply to any Accommodation included in a Listing you post (including having all required permits, licenses and registrations);
4. Must guarantee the good condition of the vessel, following regulations and producer recommendations
5. Must meet all the security requirements, security tools included and all required by applicable low;
6. Must maintain proof that the boat has his own valid insurance policy, included one for offered services, as required by applicable law;
7. Must meet minimum security, health and cleanness requirements
8. Must have full tank (water – fuel) at the check-in and guarantee all services feasibility;
9. Must guarantee that every modification or alteration was done under due authorization by the constructor or by the Certification Authorities recognized by its jurisdiction;
10. Please note that the compliance with whatever requirement is on the owner of the boat and in no case, this website can be considered responsible.
The Vob Manager or a delegate has also these duties:

1. Welcome the customers at the time and at the place agreed on the booking;
2. Check the identity of the customers;
3. The delegate has to declare his qualification during check-in procedures;
4. Check the valid driving boat license of the captain (if required by the local law);
5. Teach the customers the basic instructions to the use of all facilities (rooms, kitchen, bath, living room, equipment, facilities);
6. Inform on specific rules to keep in the boat, show where fire extinguishers and other security equipment are located ;
7. Be available for assistance and emergency situations;
8. Teach the captain about the specific use of the control and propulsion equipment of the vessel/boat;
9. Check the boat to analyze with the clients any previous damage;
10. Teach the customer about emergency water support, related to the local coast guard and the procedure in case of accident. Provide emergency numbers;
11. Be present at the checkout. After the checkout, the Vob Manager has a 24-hrs period to denounce any damage, theft, or abuse inside or outside the vessel or boat during the use of the service by the customer.
IF YOU ARE NOT THE OWNER OF THE BOAT ORE THE WATER-VESSEL, YOU REPRESENT, WARRANT AND UNDERTAKE THAT YOU HAVE THE EXPRESS AUTHORIZATION FROM THE OWNER TO DEAL WITH THE BOAT, INCLUDING CREATING LISTINGS RELATED TO IT AND OFFERING IT FOR RENTAL.
For the customer:
You warrant, represent and undertake that your behavior and your use of the services through Ventureonboard.com will comply with the following conduct code. In particular the customer:
1. Must have a legal age, according to the local government law and be eligible to drive a boat;
2. If under age passengers are present, must be fully responsible for them;
3. Must exhibit a valid identification document to the Vob Manager for all guests;
4. Must leave the boat the day and hour agreed while booking. Exception made for late check out, clients cannot stay more than the agreed time on the vessel.
5. Must respect all laws and regulations while driving/using the boat
6. Must respect property laws. Client shall not damage or steal any part, external or internal, of the vessel. Clients shall not take possession of any object found on the vessel.
7. Must show a non-expired license and proof the effective ability to drive the vessel, when required so.
8. Must follow good behavior rules (noisy, nuisance and any kind of disturb)
9. Must conduct the vessel only within the national geographical area, within the distance allowed on the security certificate or within other agreed limits.
10. Could be responsible for damage occurred on the vessel or to the vessel. Must immediately report them and could be liable for repairing costs.
11. Must not host more people than agreed and in any case no more than allowed by boat regulations.
12. Must not commit any illegal action while on the vessel.
13. Must take into consideration that any booking can be cancelled due to prohibitive weather conditions.
14. Must take pictures of any previous damage of the boat not reported before leaving. Pictures must proof to be taken before the leaving time. Any other not reported damage could be fix at clients’ expense. Client will be responsible even if not in charge of the vessel.
15. Must pay any fine, ticket and must be responsible for any reporting occurred while the boat was booked. Once received, the Vob Manager will contact the client responsible for that.
16. Must conduct the vessel with due diligence and be back within the agreed period for the check-out.
17. Must not conduct the vessel under the influence of any substance or drug.
18. Must not take part into competitions, if not explicitly agreed so.
19. Must not give a ride to other people, carry/pull other vessels or conduct any illegal activity.
20. Must always take into consideration the weather conditions and sea conditions.
21. Must not transfer his contract to any third part.
22. If an accident should occur, must follow the procedure agreed on the insurance policy and immediately contact the Vob Manager
23. Must come back with full tanks, if not previously agreed upon differently.
Any kind of abuse of the following rules, including damage at people, properties of any third party will be punishable by law. Hob Srl is not responsible for any misconduct, or unlawful conduct of the customer.

In addition, to the correct use of the service, the customer has these duties:

1. Must meet the Vob Manager at the time and at the place agreed on the booking;
2. Must respect any other additional specific conditions given by the Vob Manager agreed on the welcome stage;
3. Must declare any specific and particular needs at the Vob Manager during the booking or during the welcome stage;


8. Event and Excursions Ticket’s Conditions

For the Vob Manager:
You warrant, represent and undertake that any listing you publish on www.Ventureonboard.com relate to an available and existing boat or vessel, it is in seaworthy conditions, safe and suitable to host people, free of any known fault of defects that would affect its safe operation and navigation under normal use and that the vessel / boat conforms to the eligibility requirements as stated in the Boat Eligibility Requirements.
As Vob manager/owner, you are entirely responsible for the accuracy of the description, referring to the excursions and proposed events; you are also responsible for professional law requirements and for any further legal rule of the State where you operate.
You are responsible for boat details, rules and regulations of boat ownership and its utilization, in conformity with the suitability requirements upon the jurisdiction where the boat will be used.
You grant that any described experience in your profile doesn’t breach any agreement with third parties (e.g. tourist operators) and meets all applicable laws, tax rules and whatever rule should be implied (such as tourism regulation, driving permits and other applicable rules to tourist public events).
You represent and warrant that your Profile and your Planning of and/or Guidance on any event, excursion or in general called experience:
– will not breach any agreements you have entered into with any third parties (such as any agreements with or rules of employers or local tourism agencies);
 Will comply with all applicable laws, tax requirements, and rules and regulations that may apply to any such Experience, including, but not limited to, tourism, tour guide licensing laws, and other laws governing events and tours of public spaces and other venues and not in conflict with the rights of third parties.
Please note that Ventureonboard.com assumes no responsibility for any Vob Manager or Customer compliance with any applicable laws, rules and regulations.
Ventureonboard.com recommends that Vob Managers and Customers obtain appropriate insurance for their Experiences. Please review any insurance policy that you may have for your Experience carefully, and in particular please make sure that you are familiar with and understand any exclusions to, and any deductibles that may apply for, such insurance policy, including, but not limited to, whether or not your insurance policy will cover the actions or inactions of Customers (and the individuals the Customers invites to the event, excursion or in general to the experience, if applicable) while participating in your Experience.
If the experience is carried out through a boat, IT IS YOUR OWN RESPONSIBILITY that the vessel complies with these minimum requirements (this is a qualitative list, not to be considered exhaustive):
1. Must have a valid authorization of the marina berths or moorings;
2. Must not breach any agreements you have entered into with any third parties;
3. Must be in compliance with all applicable laws (such as laws governing the rental of boating accommodation or accommodation generally in the jurisdiction in which the Accommodation is located), Tax requirements, and any rules and regulations that may apply to any Accommodation included in a Listing you post (including having all required permits, licenses and registrations)
4. Must guarantee a good condition of the vessel, following producer recommendations and regulations
5. Must meet minimum requirements of health, cleanliness and safety to host people
6. Must proof that the boat has his own valid insurance policy as required by applicable law.
7. Must have full water tanks at the check in and guarantee any offered service is feasible,
8. Must guarantee all the alterations and modifications (if any) were done under proper authorization by the constructor or the certification agencies,
9. Will be responsible in meeting minimum requirements. The website is not responsible in any case for compliance failings.

The Vob Manager has also the following duties:

1. Must appoint a boat Captain for the period of the event (the Vob Manager can be also the captain). If local laws require so, he/she must provide proof of a valid title for that specific activity; if necessary, a valid number of people (with due requirements) must be available for cooperation.
2. In case that a Captain is a different person from the Vob Manager, the Vob Manager must teach the captain about the specific use of the control and propulsion equipment of the vessel/boat. He must also show the passengers all security equipment locations.

The Captain (could also be the Vob Manager) has these duties:

1. Welcome the customers at the time and at the place agreed on the booking.
2. Check the identity of the customers
3. Teach the customers the basic instructions to the use of all facilities (rooms, kitchen, bath, living room, equipment, facilities)
4. Inform on specific rules to keep in the boat
5. Must conduct the vessel following the nautical rules, granting as major goal the safety and comfort of all passengers.
6. Must be available for assistance and emergency situations.
If you are not the owner of the Boat, you represent, warrant and undertake that you have the express authorization from the owner to deal with the Boat, including creating listings related to it and offering it for rental.
For the customer:
You warrant, represent and undertake that your behavior and your use of the services through www.Ventureonboard.com will comply with the following conduct code.
In particular the customer:
1. Exhibit a valid identification document to the Vob Manager for all guests
2. Must respect property laws
3. Must follow a civil behavior conduct
4. May be considered responsible for any damage occurred during the permanence on board and must immediately report any accident; he will pay for any repair call.
5. Must not commit illegal activities inside the vessel / boat
6. Must accept that any event could be cancelled due to severe weather conditions.
7. Must not be on board under the influence of drugs or alcohol.
8. Must accept that the natural show may not occur because of natural reasons (in case of Dolphins watching and no dolphin shows up, the captain is not responsible!)

Any kind of abuse of the following rules, including damage toward people or properties of any third party will be punishable by law. Hob Srl is not responsible for any misconduct or unlawful conduct of the customer.

In addition, to the correct use of the service, the customer has these duties:

1. Must meet the Captain at the time and at the place agreed on the booking;
2. Must respect any other additional specific conditions given by the Captain agreed on the welcome stage;
3. Must declare any specific and particular needs to the Captain during the booking or during the welcome stage;

Ventureonboard.com strongly recommends obtaining proper insurance policies for any proposed activity. Please read carefully any signed policy. Particular attention must be given to exclusions, excesses and deductibles.


9. Specific conditions for technical assistance services (maintenance and repair services)

For Vob Managers:
You warrant, represent and undertake that any listing you publish on www.Ventureonboard.com relates to an available and existing service on a real and existing boat, which is in seaworthy conditions, safe and suitable to host people, free of any known fault of defects that would affect its safe operation and navigation under normal use and that the vessel / boat conforms to the eligibility requirements as stated in the Boat Eligibility Requirements.
As Vob Manager, you are entirely responsible for any detailed service offered on the website, in conformity with the professional suitability requirements upon the jurisdiction where the boat will be used.
You grant that your offered service on Ventureonboard.com:
– Doesn’t breach any third parties agreement (e.g. local tourist agencies or local entrepreneur)
– Meets all the legal requirements, tax laws and any other applicable law to maintenance service, exceptional or not. You must also check the necessary minimal competences legally required for any maintenance service, upon the law where you will operate.
YOU WILL BE RESPONSIBLE FOR ANY DAMAGE OCCURRED ON THE BOAT DURING YOUR INTERVENTION, OR ANY RELATED BOAT ITEM. IF A DAMAGE OCCURRED, PLEASE AVOID ANY FURTHER ATTEMPT TO FIX THE PROBLEM WITHOUT PRIOR CONSENT OF THE OWNER.
For the client:
You will not interfere with any maintenance operation. Even when asked, please avoid any attempt to cooperate during maintenance; you will be responsible for the damage occurred.


10. Accounts

You may view listings of Accommodation, rental and ticket events, excursions or services, as an unregistered visitor to the site; however, prior to booking, listing or using a service, you should provide your data, which will be used automatically to register you to the site and to create your account. However, if you want to create an account, you must first register to create a Ventureonboard.com user account (“Account”).
Your Account and your Ventureonboard.com Account profile page will be created based upon the personal information you provide to us or that we obtain via a third party as described below. You may not have more than one active Account at a time.
Account Registration
You may register for an Account through our site by going to the site, following the instructions given and providing the requested information.
You may also register for an Account by logging in with certain third-party social networking sites (“SNS”) (including, but not limited to, Facebook; each such account, a “Third-Party Account”), via our site, as described below. You may link your Account with Third-Party Accounts, by either: (i) providing your Third-Party Account login information to Ventureonboard.com through the site or Application; or (ii) allowing Ventureonboard.com to access your Third-Party Account, as permitted under the applicable terms and conditions that govern your use of each Third-Party Account. You represent that you are entitled to disclose your Third-Party Account login information to Ventureonboard.com and/or grant Ventureonboard.com access to your Third-Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account and without obligating Ventureonboard.com to pay any fees or making Ventureonboard.com subject to any usage limitations imposed by such third-party service providers. By granting Ventureonboard.com access to any Third-Party Accounts, you understand that Ventureonboard.com will access, make available and store (if applicable) any Content that you have provided to and stored in your Third-Party Account (“SNS Content”) so that it is available on and through the site, Services and Application via your Account and Account profile page. Unless otherwise specified in these Terms, all SNS Content, if any, will be considered to be Content submitted to the site by you for all purposes of these Terms (including specifically Section 16 (Use of the site). Depending on the Third-Party Accounts, you choose and subject to the privacy settings that you have set in such Third-Party Accounts, personally identifiable information that you post to your Third-Party Accounts will be available on and through your Account on the site. Please note that if a Third- Party Account or associated service becomes unavailable or Ventureonboard.com’s access to such Third-Party Account is terminated by the third-party service provider, then SNS Content will no longer be available on and through the site, Services and Application. PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD-PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH THIRD-PARTY SERVICE PROVIDERS. Ventureonboard.com makes no effort to review any SNS Content for any purpose, including but not limited to for accuracy, legality or non-infringement and Ventureonboard.com is not responsible for any SNS Content.
Accurate and up to date information
You agree to provide accurate, current and complete information during the registration process and to update such information to ensure it is accurate, current and complete. Ventureonboard.com reserves the right to suspend or terminate your Account and your access to the site and Services if you create more than one (1) Account or if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete.
Password security
You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Account, whether or not you have authorized such activities or actions. You will immediately notify Ventureonboard.com of any unauthorized use of your Account.
Account Communications
You agree to allow Ventureonboard.com to contact you on your email address or phone number with personal communications related to your Account, including but not limited to requests for bookings, booking confirmations, notices and updates. You will be able to opt out of any future commercial communication at your convenience.
Account Restrictions
You agree to use your Account for your personal use only, and not to redistribute any of the content on this site. You agree to comply with all applicable laws regarding use or access of your Account and the provisions of section 16 (Use of the site) of these Terms. Any use of an Account in breach of section 16 (Use of the site) of these Terms and any use of an Account to post (a) false, outdated, misleading information; (b) information that in our sole discretion is inappropriate to our users (including, but not limited to obscene, libelous, slanderous or similarly inappropriate postings) or (c) information in breach any policies published on the site, are grounds for immediate termination of an Account.


11. Listings

As a registered user of the site you will be able to create Listings. To create a Listing you should follow the instructions set out on the site. You will be need to provide detailed information about the service offered (such as the kind of trip, the kind of maintenance…) and about the Boat to be listed, including, but not limited to, the location, capacity, size, features, and availability of the Rental / Boat and pricing and related rules and financial terms.
Pricing
Listings will be made publicly available via the site and via the App or other our services. Other eligible Users will be able to book a service via the site and Services based upon the information provided in your Listing. You, and not Ventureonboard.com, are solely responsible for determining the price to be displayed in your listing and any additional charges (for example, cleaning fees) to be included or factored into such price. You understand and agree that once a Customer requests a booking of your Boat, you may not request the Customer to pay a higher price than that stated in the booking request.
Ventureonboard.com as limited authorized payment collection agent
As a Vob Manager, you understand and agree that Ventureonboard.com does not act as an insurer, as a broker or as your contracting agent. If a Customer requests a booking of a boat or of any other service offered, any agreement you enter into with such Customer is between you and the Customer and Ventureonboard.com is not a party. Notwithstanding the foregoing, Ventureonboard.com serves as the limited authorized payment collection agent of the Vob Manager for the purpose of accepting, on behalf of the Vob Manager, payments from the Customer of such amounts stipulated by the Vob Manager (including, but not limited to, cleaning or other fees and/or Taxes).
As a Customer you have the responsibility for your booking and you hereby authorize Ventureonboard.com to act as your limited authorized payment collection agent for the purposes set out above.
Customer requirements and acceptance of Customers
When you create a Listing, you, as a Vob Manager, may also choose to include certain requirements, which must be met by the Users who are eligible to request a booking of your Boat or rent your Boat, including, but not limited to, requiring Users to have a profile picture or verified phone number. Any User wishing to book Boats or Rental included in Listings with such requirements must meet these requirements.
If you are a Vob Manager, Ventureonboard.com may make certain tools available to you to help you to make informed decisions about which Users you choose to confirm for booking for your Boat or for you renting your Boat. You acknowledge and agree that you are solely responsible for your own acts and omissions. Ventureonboard.com does not make any representation, warranty or guarantee about the suitability of any Customer you may accept for a booking of your Boat or rent your Boat.
Insurance
Ventureonboard.com recommends that Vob Managers obtain appropriate insurance for their Boats and for the actions made in providing the service. Please review any insurance policy that you may have for your Boat carefully, and in particular please make sure that you are familiar with and understand any exclusions to, and any deductibles that may apply for, such insurance policy, including, but not limited to, whether or not your insurance policy will cover the actions or inactions of Customers (and the individuals the Customer invites to the Boat, if applicable) while they are on your Boat.
Verified Images
Ventureonboard.com may offer to Vob Managers or to Customers with the authorization of the Vob Managers, the option of having photographers take photographs of their Boats. If you as a Vob Manager choose to have a photographer do this, the photographs taken will be made available to you to include in your Listing with a watermark or tag bearing the words “Ventureonboard.com Verified Photo” or similar wording (“Verified Images”). All images, materials and content created by these photographers provided by Ventureonboard.com, including Verified Images, constitute Content belonging to Ventureonboard.com, regardless of whether you include them in your Listing.


12. Bookings

Bookings by Customers
Customers can request a booking through the site by following the processes for making a booking request set out on the site and clicking on the appropriate confirmation button. You will have the opportunity to communicate with the relevant Vob Manager via our site messaging service and to raise any queries about the Boat or the terms of the Listing before confirming your booking request. It is important that Customers check the information entered and correct any errors before making a booking request since once you click on such button or link, input errors cannot be corrected.
Prior to confirming your booking request, you will be asked to provide payment card details. Ventureonboard.com will also obtain a pre-authorization on your payment card for the total amount of your booking request to ensure that you have the necessary amount of funds available to cover the transaction. If your booking request is accepted by the Vob Manager for the dates set out in your request, the payment process described under section 8 (Fees, Charges and Payment) of these Terms below will apply. If a booking request is refused, expires or is cancelled, any pre-authorization of your payment card will be released or as applicable, shall expire after a period of up to 30 days unless you contact us to request an earlier release.
Once you have provided your payment card details, you will be requested to click the booking confirmation button. If at any time prior to clicking on the appropriate confirmation button, you (the Customer) decide that you do not wish to proceed with your booking request, you should close the application window.
Once your booking request has been made, we will then notify the relevant Vob Manager by email and via their Account instructing them to accept or reject the booking request. Vob Managers are required to either confirm or reject your booking request within 24 hours of that request, after which the booking request shall automatically expire. If the Vob Manager through our site subsequently accepts the booking request, you will receive confirmation via email and via your Account.
Upon receipt of a booking confirmation, Customers enter into a direct contract with the concerned Vob Manager. Vob Managers are not obliged to make any Boat available until a booking confirmation has been sent by the Vob Manager via the site to Customers and a Customer is not guaranteed a booking with a Vob Manager until payment has been made by the Customer subject to these Terms.
As a Customer, if you cancel your booking, the provisions and refund levels of section “Customer Changes and Cancellations” of these Terms below will apply.
Any monies collected and received by Ventureonboard.com from Customers for bookings made on the site shall be held by Ventureonboard.com subject to a conditional obligation to transfer or account for such monies to Vob Managers less our Fees.
Confirmation of Bookings by Vob Managers
If you are a Vob Manager and a booking is requested for your Boat via the site, you will be required to either confirm or reject the booking request within 24 hours; otherwise, the booking request will be automatically cancelled. When a booking is requested via the site, we will share with you (i) the first and last name of the customer who has requested the booking; and (ii) a link to the Customer’s Ventureonboard.com Account profile page, so that you can view such information before confirming or rejecting the booking request. If you are unable to confirm or decide to reject a booking request within the 24 hours, any amounts collected by Ventureonboard.com for the requested booking will be refunded to the applicable Customer’s credit card and any pre-authorization of such credit card will be released. When you confirm a booking requested by a Customer, Ventureonboard.com will send you an email and notify you via your Account confirming such booking.
As a Vob Manager, you agree that any bookings made between you and a Customer to whom you have been introduced by the site or Services must be confirmed and paid for via the site. You cannot propose and deviate in any case the user towards other services offered by other sources different from Ventureonboard.com website. If you do conclude or accept a payment out of our web platform you shall be liable to pay to Ventureonboard.com a minimum penalty of Gbp 11.000,- (GBP eleven thousand ) for each violation found, subject to greater damage by way of compensation.


13. Fees, Charges and Payment

Key Definitions
Tariffs are the fees charged by a Vob Manager to a Customer in exchange for the service offered on the website. The Tariffs are set by the Vob Manager and not by Ventureonboard.com. The Vob Manager may decide to include within these fees amounts payable in respect of tax, which the Vob Manager determines he or she is liable to collect;
Additional Charges are additional fees charged by a Vob Manager to a Customer (such as cleaning fee, tender, particular sails or equipment, or other extra services) which the Vob Manager may require at its discretion;
Customer Booking Fee is the fee charged by Ventureonboard.com to Customers for use of the Ventureonboard.com web Services and is calculated as a percentage of the applicable Tariff and additional charged together with any applicable VAT or other similar tax. This percentage could vary. Moreover, it could vary also depending on the amount of the total fees, or on particular events or agreements;
Vob Manager Booking Fee is the fee charged by Ventureonboard.com to Vob Managers to Ventureonboard.com for use of the Ventureonboard.com Services and is calculated as a percentage of the applicable Tariff together with other Additional Charges and any applicable VAT or other similar tax;
Total Fees means the entire amount, which must be paid by the Costumer. It includes the Tariffs any Additional Charges and the Customer Booking Fee.
Fees and Charges Payable by Customers
Before a Customer sends a booking request to a Vob Manager, all fees and charges payable in connection with the booking will be clearly displayed.
Fees payable by Customers comprise: (i) the Tariff; (ii) any Additional Charges; and (iii) the Customer Booking Fee; (iv) eventual deposit if required. The Total Fees are due and payable upon confirmation of a booking.
You as a Customer agree to pay Ventureonboard.com the Total Fees for any booking requested in connection with your Ventureonboard.com Account if the applicable Vob Manager confirms such requested bookings. In order to establish a booking pending the applicable Vob Manager’s confirmation of your requested booking, you understand and agree that Ventureonboard.com, reserve the right, in its sole discretion, to (i) obtain a pre-authorization via your credit card for the Total Fees or (ii) charge your credit card a nominal amount, not to exceed one pound sterling (Gbp 1), or a similar sum in the currency in which you are transacting (e.g. one pound or US dollar or one euro), to verify your credit card. Once Ventureonboard.com receives confirmation of your booking from the applicable Vob Manager, Ventureonboard.com will collect the Total Fees in accordance with these Terms and the pricing terms set forth in the applicable Listing. Please note that Ventureonboard.com cannot control any fees that may be charged to a Customer by his or her bank related to Ventureonboard.com’s collection of the Total Fees, and Ventureonboard.com disclaims all liability in this regard.
In connection with your requested booking, you will be asked to provide customary billing information such as name, billing address and credit card information either to Ventureonboard.com or to its third-party payment processor. You agree to pay Ventureonboard.com for any confirmed bookings made in connection with your Ventureonboard.com in accordance with these Terms by one of the methods described on the site. You hereby authorize the collection of such amounts by charging the credit card provided as part of requesting the booking, either directly by Ventureonboard.com or indirectly, via a third-party online payment processor or by one of the payment methods described on the site. You also authorize Ventureonboard.com to charge your credit card in the event of damage caused at a Boat as contemplated under section “Damage to Boats” of these Terms and for Security Deposits, if applicable. (If you are directed to Ventureonboard.com’s third-party payment processor(s), you may be subject to terms and conditions governing use of that third party’s service and that third party’s personal information collection practices. Please review such Terms and Conditions and privacy policy before using the services.) Once your confirmed booking transaction is complete, you will receive a confirmation email summarizing your confirmed booking.
Security Deposits
Vob Managers may choose to include security deposits in their Listings (“Security Deposits”). Each Listing will describe whether a Security Deposit is required for the applicable Boat or service. When a Booking request is accepted, the Security Deposit details and Customer’s payment information is stored. When required, the deposit must be paid at least 48 hours before the check-in date, otherwise the booking is deleted. No charges or authorizations will be made to the Customer’s payment method unless the Vob Manager needs to make a claim. A Vob Manager has 24 hours after the checkout date to make a claim on the Security Deposit. Ventureonboard.com is not responsible for administering or accepting any claims by Vob Managers related to Security Deposits, and disclaims any and all liability in this regard.
As a Vob Manager, you acknowledge and accept that Ventureonboard.com will only be able to recover amounts under a Security Deposit from a Customer’s credit card to the extent that the credit card details submitted by the Customer remain valid at the time of claim and that the relevant credit card has sufficient credit available at that time to meet the claim.
Other costs after the usage
As a Costumer, you understand and agree that in case of a non-resolution dispute between you and the Vob Manager, Ventureonboard.com can charge, also the following penalties, when one of the next events occurs:
Penalty for delay: In the case, you return a boat after the agreed upon time, a penalty of a one-time sum of GBP 100, 00 plus double the agreed fee will be charged. If your delay will create any problem to a following booking, you will have to pay also the total refund to the next costumer who could not use the service with that boat.
Penalty for dirty boat: in the case when you bring the boat back at the end of the rental period and it is particularly dirty, or it has not been cleaned by the costumer and the cleaning fees have not been charged, you will be issued a fee in the amount of GBP 100, 00 plus any other extraordinary cleaning costs
Other penalties for damages or lost objects: a penalty fee in the amount of GBP 100, 00 will be charged in addition to the costs of the reparation or of the replacement of the lost or damaged objects (e.g. inappropriate usage of fire extinguishers).
Fees payable by Vob Managers
Ventureonboard.com will collect the Total Fees at the time of booking confirmation (i.e. when the Vob Manager confirms the booking request) and will initiate payment of the Tariffs and any Additional Charges to the Vob Manager after 24 hours from the check-in (except to the extent that a refund is due to the Customer). Vob Managers will be paid by means of telegraphic transfer to the bank account details provided by the Vob Manager to Ventureonboard.com through their registered Account or by any other electronic means previously agreed upon. Any bank charges levied in connection with a transfer of funds to a Vob Manager shall be deducted from the amount payable to that Vob Manager.
If you owe or agree to pay any amount to Ventureonboard.com (whether as a result of your bookings or actions as a Customer or otherwise), then Ventureonboard.com may (but is not obliged to) withhold the amount owing to Ventureonboard.com from any payout amounts due to you as a Vob Manager, and use the withheld amount to setoff the amount owed by you to Ventureonboard.com. If Ventureonboard.com does so, then your obligation to pay Ventureonboard.com will be extinguished to the extent of the amount withheld by Ventureonboard.com, and Ventureonboard.com will cease to owe to you any obligations (including, but not limited to, any obligation to pay you) with respect to the amount withheld.
Vob Manager’s Taxes
As Vob Manager you understand and agree that you are solely responsible for determining (i) your applicable Tax reporting requirements, and (ii) the Taxes that should be included, and for including Taxes to be collected or obligations relating to applicable Taxes in Listings. You are also solely responsible for remitting to the relevant authority any Taxes included or received by you. Ventureonboard.com is not liable to any extent for the taxes due from services providers, cannot, and does not offer Tax-related advice to any Users, relating to any content on the Website.


14. Customers’ Changes and Cancellations

Changes
If Customers want to change their booking, such Customers will need to contact and communicate with their Vob Manager directly on such changes. Customers should note however that as they have previously agreed and accepted terms with the Vob Manager in respect of the booking, the Vob Manager is entitled to, and may therefore, charge Customers additional charges for such changes.
Cancellations
Customers may cancel their booking at any time on the site, by clicking on “booking cancellation”, the cancellation is confirmed when the customer clicks on “booking cancellation”.
If you, as a customer, wish to cancel any booking before the Vob manager confirms it, Ventureonboard.com will release any pre-authorization on the credit card and it will refund any amount related to the booking and charged on the credit card, according to average bank timings,
If you, as a customer, wish to cancel a booking, which has already been confirmed by the Vob manager, conditions of cancellation will rely on the conditions of cancellation settled by the Vob manager on his offer. Each Vob manager has the right to choose his own terms of cancellation in order to prevent himself from unjustified cancellations.
Ventureonboard.com will refund the amount according to necessary timings and according to Vob manager’s cancellation policy.
Any fare or commission applied as management cost or any other tax applied cannot be refunded.
Cancellation policies between which the Vob manager can choose are the followings:
• 48h easy: all the cancellations made within 48h to the time of the check-in are fully refunded (based on local time of the place where the check-in would take place);
• 7days flat: all the cancellations made within 7 days from the date of the check-in will be fully refunded;
• 21days standard: all the cancellations made within 21 days from the date of the check-in will be fully refunded;
• Percentage method: all the cancellations will be refunded according to the following percentages based on the delay of the cancellation:
120 days 100%
60-119 days 50%
40- 59 days 20%
From 39 to 0 0%
Please note that these conditions may vary.
Mitigating circumstances for the refund:
Ventureonboard.com might change or suspend penalty policy for cancellation due to certain circumstances, such as:
– Death in the family;
– Natural disaster;
– Political instability;
– Bad weather that could compromise customers security, such as storms, weather warning, forecasted for the check-in date and the following days;
– The boat does not exist or the Vob Manager does not allow customers to have access to the boat or at the service without reason;
– Quality issues on the responsibility of Vob Managers, customers need to notify these problems within 24 hours from the time of the check-in.
– Problems during the usage of the service due to serious negligence of the Vob Manager, customers need to notify these problems within 24 hours from the arrival at the check-in.
– If the service does not correlate to what the Vob Manager stated in his announcement, concerning: the size of the boat, number of people the boat can host, model, services promised but not available, siting of the boat etc. customers need to notify these problems within 24 hours from the time of check-in.


15. Cancellations by Vob Managers and Material Quality Issues

If a customer raises any quality or material issue related to the boat, or if the boat or any other service offered on the website does not correspond to reality, the matter shall be dealt with in accordance with Ventureonboard.com Customer Refund Policy, as previously stated. Ventureonboat.com will refund all the payments except for the management costs, within a reasonable time after the cancellation. The Customer Refund Policy forms part of these Terms and should be read carefully.
Please notice that Ventureonboard.com is not responsible for banking execution times.
As a Vob Manager, you are allowed to cancel a booking that has already been confirmed, in the following situations:
1 Actual or forecasted weather or sea conditions are not safe enough.
2. If the qualifications of the customer who is going to “captain” is not sufficient to allow him to navigate or captain the boat.

In these situations, the customer will receive a 100% refund of the price of the service and any other costs applied, minus any non-refundable management fees or applied taxes. PLEASE NOTICE THAT any fare or commission applied as management cost or any other tax applied cannot be refunded
If you, as a Vob Manager, cancel a confirmed booking without any reason, or in any case a Material Quality Issue is held in connection with a Boat you Listed, Ventureonboard.com, in addition to the full refund, may apply penalties or consequences to you or your Listings, such as:
– Negative feedback reporting the unjustified cancellation;
– Temporary block of the Announcement calendar;
– Penalties retained on future bookings;
In any case, the Vob Manager decides to cancel a booking, the customer will receive an email or a different notification reporting the cancellation. The customer will have the possibility to:
– Ask for a total refund by clicking on “Ask for Refund”;
– Book another service on the website by using the same credit, please notice that the amount of your credit will not cover NEW MANAGEMENT AND USING COSTS. The customer will be charged of a new payment for any eventual price difference between the first and the second booking. If the second booking will result cheaper than the first one, Ventureonboard.com will refund the difference.

Ventureonboard.com has the right to, and may therefore; cancel a booking on its total discretion, on the reasons stated on the mitigating circumstances or for any other reason. There could be circumstances where Ventureonboard.com could refund an entire booking or part of the amount payed, by following what mentioned on the refund policy. By accepting these terms and conditions you accept that nor host nor customer nor Vob Managers are responsible for those cancelations and refunding.
If you, as a Vob manager, receive a cancellation for a confirmed booking from the customer or from ventureonboard.com itself, and for this cancellation, ventureonboard.com refunds the customer on behalf of what is stated on the Refund Policy, you accept that any monies that have been received by the Vob Manger, Ventureonboard.com has the right to retrieve from your account the amount refunded. This amount could be entirely charged by using one of the payment methods you have chosen or could be taken from future payments on your services.
Price Rounding
Customers and Vob Managers accept that Ventureonboard.com can round up or round down prices and fares to the nearest integer, in its total discretion. Some currencies are denominated in large numbers, in those cases, the amount could be rounded up to the nearest integer on 10, 100, 1000 base according to the differences between two different currencies.
Errors during transactions
In case errors of any kind occur during the payments, you accept that Ventureonboard.com can solve the problem by charging or refunding the amounts needed. Ventureonboard.com can use in this purpose the payment method you have chosen on your profile.
Donations
Some Vob managers may pledge to donate a portion of the funds they receive from confirmed bookings. You accept that we do not take any responsibility or liability for whether the Vob Manager does in fact make the donation he or she pledged to make. In such cases, the Vob Manager in question is responsible for his or her own compliance with all laws and regulations applicable to such pledges and/or fund-raising.


16. Damage to Boats

As a Customer, you are responsible for leaving the Boat in the condition it was in when you arrived. You acknowledge and agree that, as a Customer, you are responsible for your own acts and omissions and you are responsible for the acts and omissions of any individuals whom you invite to, or otherwise provide access to, the Boat. In the event that a Vob Manager claims otherwise and provides evidence of damage, including but not limited to photographs, you agree to pay the cost of replacing the damaged items with equivalent items. After being notified of the claim and given forty eight (48) hours to respond, the payment will be charged to and taken from: the credit card on file in your Ventureonboard.com Account, or from the other electronic means previously agreed for the payment. Ventureonboard.com also reserves the right to charge the credit card on file in your Ventureonboard.com Account, or otherwise collect payment from you and pursue any avenues available to Ventureonboard.com in this regard, including using Security Deposits, or charging the other electronic means previously agreed for the payment. In situations in which you have been determined, in Ventureonboard.com’s sole discretion, to have damaged any Boat and if we are unable to charge the credit card on file or otherwise collect payment from you, you agree to remit payment for any damage to the Boat to the applicable Vob Manager and/or to Ventureonboard.com (if applicable).
Both Customers and Vob Managers agree to cooperate with and assist Ventureonboard.com in good faith, and to provide Ventureonboard.com with such information and take such actions as may be reasonably requested by Ventureonboard.com, in connection with any complaints or claims made in connection with Boats or any personal or other property located on a Boat or with respect to any investigation undertaken by Ventureonboard.com or a representative of Ventureonboard.com regarding use or abuse of the site or the Services.


17. Disclaimers

If you choose to use the site or services, you do so at your sole risk. you acknowledge and agree that ventureonboard.com does not have an obligation to conduct background checks on any member, including, but not limited to, customers and vob managers, but may conduct such background checks in its sole discretion. the site and services are provided “as is”, without warranty of any kind, either express or implied. without limiting the foregoing, ventureonboard.com explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment or non-infringement, and any warranties arising out of course of dealing or usage of trade. ventureonboard.com makes no warranty that the site or services including, but not limited to, the listings or any Boats will meet your requirements or be available on an uninterrupted, secure, or error-free basis. ventureonboard.com makes no warranty regarding the quality of any listings, boats, the services or the accuracy, timeliness, truthfulness, completeness or reliability of any collective content obtained through the site or services.
No advice or information, whether oral or written, obtained from ventureonboard.com or through the site or services, will create any warranty not expressly made herein.
You are solely responsible for all of your communications and interactions with other users of the site or services and with other persons with whom youcommunicate or interact as a result of your use of the site or services, including, but not limited to, any vob managers or customers. you understand that ventureonboard.com does not make any attempt to verify the statements of users of the site or services or to review or visit any boats. ventureonboard.com makes no representations or warranties as to the conduct of users of the site or services or their compatibility with any current or future users of the site or services. you agree to take reasonable precautions in all communications and interactions with other users of the site or services and with other persons with whom you communicate or interact as a result of your use of the site or services, including, but not limited to, customers and vob managers, particularly if you decide to meet offline or in person regardless of whether such meetings are organised by ventureonboard.com. notwithstanding ventureonboard.com’s appointment as the limited payment collection agent of the vob managers for the purpose of accepting payments from customers on behalf of the vob managers, ventureonboard.com explicitly disclaims all liability for any act or omission of any customer or other third party.


18. Limitation of Liability

You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the site or services, your listing or booking of any boats via the site or services and any contact you have with other users of ventureonboard.com whether in person or online remains with you. neither ventureonboard.com nor any other party involved in creating, producing, or delivering the site or services will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with these terms, from the use of or inability to use the site or services, from any communications, interactions or meetings with other users of the site or services or other persons with whom you communicate or interact as a result of your use of the site or services or from your listing or booking of any boat via the site or services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not ventureonboard.com has been informed of the possibility of such damage.

19. Indemnification

You agree to release, defend, indemnify, and hold Ventureonboard.com and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (a) your access to or use of the site or Services or your violation of these Terms; (b) your Member Content; (c) your (i) interaction with any member, (ii) booking of an boat, or (iii) creation of a Listing; and (d) the use, condition or rental of a Boat by you, including but not limited to any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of a rental, booking or use of a boat.


20. Agreement

These Terms & Conditions can be considered the Understanding and the exclusive agreement between Ventureonboard.com and you regarding the Site, App, Services, Content and any reservation or published listing, made through the site, the App and Services, and these Terms supersede all prior oral or written agreements, between Ventureonboard.com and you, regarding the booking or listing, the Site, App, Services, content.

(e) not to use the site or Services to find a Vob Manager or Customer and then complete a booking of an Boat or of other listed offer independent of the site or Services, in order to circumvent the obligation to pay any Fees related to Ventureonboard.com provision of the Services or for any other reasons;
(f) not to use the site to commit any act of fraud;
(g) not to use the site to distribute viruses or malware or other similar harmful software code;
(h) not to use the site for purposes of promoting unsolicited advertising or sending spam;
(i) not to use the site to simulate communications from us or another service or entity in order to collect identity information, authentication credentials, or other information (‘phishing’);
(j) not to use the site in any manner that disrupts the operation of our site or business or the website or business of any other entity;
(k) not to use the site in any manner that harms minors;
(l) not to promote any unlawful activity;
